By subscribing to simpliers' services, you acknowledge and accept the following terms and conditions.
These subscription terms are between PE PORTAKAL ENERJİ BİLİŞİM LİMİTED ŞİRKETİ and users who choose the renewal subscription method via any page or mobile application under the https://simpliers.com website (hereinafter referred to as 'Simpliers').
Simpliers reserves the right to unilaterally amend the provisions of this agreement at any time. These changes will take effect as soon as they are published on the website.
The fees for digital services and offerings under the subscription are listed on the Prices page. Simpliers reserves the right to make changes to subscription fees and services without notice.
If the user does not accept the changes in subscription fees, they have the right to cancel their subscription. Otherwise, by continuing the subscription, the user is deemed to have accepted the changes.
The subscription fee is collected via the registered payment method. Payment methods may include debit card, credit card, or in-app purchases. Users can choose subscriptions via the app store or have them automatically charged from the credit card registered in their account. If payment is not made or the selected payment method is not valid, Simpliers reserves the right to suspend access to the services. It is the user’s responsibility to keep payment method information up to date.
The service purchased by the user is delivered electronically. The service will be made available to the user for the subscription period as soon as the payment is successfully completed. The user agrees to use the service in accordance with the applicable laws and regulations. The user is responsible for any unlawful use of the service.
The user acknowledges, declares, and undertakes not to market Simpliers’ services, which are licensed in accordance with the Turkish Copyright Law No. 5846, for commercial purposes or transfer them to third parties, and that no rights not explicitly stated in this agreement are granted to the user.
Subscriptions are automatically renewed at the end of each term (Monthly, Quarterly, or Yearly) unless canceled by the user, and the service is extended until the end of the next term. The renewal fee is charged to the registered payment method. If the user wishes to cancel the subscription, the cancellation can be processed via the My Account > Subscription page. The cancellation will take effect at the end of the current subscription period.
According to Article 15 of the Distance Sales Regulation, the user cannot exercise their right of withdrawal. In accordance with this regulation, no refunds will be made for the subscription service periods already defined. If the user does not wish for the subscription to be renewed, they must cancel the subscription before the renewal date.
Simpliers reserves the right to suspend or terminate the service without prior notice in cases of non-payment, late payments, or other violations of the agreement. If the user fails to fulfill their obligations, Simpliers reserves the right to pursue legal and administrative remedies.
Users are required to define one or more payment methods for subscription fee payments. If the registered payment method becomes invalid, Simpliers reserves the right to charge fees from any other registered payment method. Payment method changes can be updated in the My Account > Payments section.
The user agrees, declares, and undertakes that in the event of disputes arising from this agreement, Simpliers’ commercial records, electronic information held in its database, and computer records will constitute binding, conclusive, and exclusive evidence and that this clause is in the nature of an evidence agreement within the meaning of Article 193 of the Turkish Code of Civil Procedure.
The invalidity, illegality, or unenforceability of any provision or statement in this agreement shall not affect the validity or enforceability of the remaining provisions.
It is the user’s responsibility to regularly check the Simpliers website for updates and information.
This agreement will be deemed accepted by the user upon purchase.
